Terms of service

These Terms of Service (“Terms”) govern your use of nikashi.in (the “Website”) and all purchases made through it. The Website is owned and operated by Nikashi Enterprises LLP (“Nikashi”, “we”, “us” or “our”), Hyderabad, Telangana, India. By accessing the Website or placing an order, you agree to be bound by these Terms.

1. Privacy

Our Privacy Policy forms part of these Terms. We collect, use and protect personal information, including sensitive personal data, in accordance with the Privacy Policy and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

2. Information you provide

You agree to provide accurate and complete information when placing an order. Orders are processed on the basis of the information you provide, and Nikashi is not liable for any loss arising from incorrect or fraudulent information. Any payment card used must be lawfully held by you; fraudulent use of a payment card is an offence under Indian law. We may contact you for additional information where required to process your order.

3. Product information

Information on the Website is provided “as is”. While we make every effort to ensure accuracy, product descriptions, images and specifications may contain errors and may be changed without notice. In line with our policy of continuous improvement, Nikashi reserves the right to modify products without prior notice. Products delivered may differ slightly in appearance from the images shown on the Website.

4. Orders and payment

• An order is accepted only once payment has been successfully processed.
• Payment may be made by credit card, debit card, UPI, net banking or any other online method offered at checkout. Cheques, money orders and cash are not accepted.
• EMI options may be available on select credit cards through our payment gateway partner.
• The billing name and address must match the details registered with your payment card; orders that do not meet this requirement may be delayed or cancelled.
• Prices, payment methods, promotions and discounts are at Nikashi’s discretion and may change without notice.
• All prices are subject to applicable taxes, including GST.

5. Payment security

Payments are processed through a payment gateway that complies with the Payment Card Industry Data Security Standard (PCI DSS) and is secured with SSL encryption. Nikashi does not store your card details. Payment information is not shared with third parties except where required for fraud prevention or by law, regulation or court order.

6. Delivery

Products are delivered within India by our third-party logistics partners. Dispatch and delivery timelines are set out in our Shipping Policy. Delivery to remote locations may take longer, and Nikashi is not liable for delays caused by logistics partners or circumstances beyond our reasonable control.

7. Returns and warranty

Returns and refunds are governed by our Refund Policy, and order cancellations by our Cancellation Policy. Products that have been damaged through misuse, tampered with, or returned with missing parts or accessories will not be accepted. Where a product’s condition has been misrepresented, Nikashi reserves the right to levy a fee of up to 15% of the sale price together with transportation costs.

Nikashi’s warranty obligations are limited to those set out in the warranty card and printed literature supplied with each product. Nikashi Enterprises LLP is directly responsible for all warranty repairs and claims. Further details are available on our Warranty & Services page.

8. Cancellation by Nikashi

Nikashi reserves the right to refuse or cancel any order, including in the following circumstances:

• Concerns identified during payment verification or fraud screening
• Errors or inaccuracies in product or pricing information, including typographical errors
• Non-availability of the product ordered

This applies whether or not the order has been confirmed. If an order is cancelled after payment, the full amount will be refunded to the original payment method; the time taken to reflect in your account depends on your bank.

9. Limitation of liability

To the maximum extent permitted by law, Nikashi shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any claim by a third party. Nikashi’s total liability in connection with any purchase shall not exceed the amount paid by you for the product concerned.

10. Indemnity

You agree to indemnify and hold harmless Nikashi Enterprises LLP and its partners, officers, employees, agents and affiliates against all claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of any law, or your infringement of the rights of any third party, including intellectual property rights.

11. Intellectual property

Nikashi is a brand of Nikashi Enterprises LLP. The Website and all of its content, including text, images, graphics, logos and design, are the property of Nikashi Enterprises LLP and are protected under the Copyright Act, 1957 and other applicable laws. You may view and download content for personal, non-commercial use only, provided it is not modified. Any other copying, reproduction or distribution without our prior written consent is prohibited.

12. Third-party websites

The Website may contain links to websites not operated by Nikashi. We do not endorse and are not responsible for the content, products or practices of such websites.

13. Governing law and jurisdiction

These Terms are governed by the laws of India. The parties shall endeavour to resolve any dispute amicably. Disputes that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts at Hyderabad, Telangana.

14. Changes to these Terms

Nikashi may update these Terms from time to time. Changes take effect when published on this page, and continued use of the Website constitutes acceptance of the revised Terms.
